What to Do If You're Fired for Reporting Discrimination

Well, if you report discrimination on a protected basis — like religion, race, gender, disability, uh, national origin, um — you’ve engaged in what’s called protected activity under Title 7 of the Civil Rights Act. And if you’re fired because of that, for speaking out, for complaining or protesting discrimination, you have rights. So, you can seek reinstatement. Uh, you can seek back pay and other remedies to make you what’s called whole. And the thing that needs to be established is a close proximity in time between your protected speech — that is, the protest or the complaint of discrimination — and the adverse employment action, which is the retaliation. If you can establish that, then you have rights you could pursue, and, uh, and you can seek to either get reinstatement or be compensated for the fact that you were fired unlawfully.
